1. About Arkive
Arkive operates a vault and marketplace for Pokémon trading cards. We act as a custodian of cards submitted by customers, and we may facilitate transactions between customers (internal marketplace) as well as on third-party platforms on behalf of customers (external sales).
2. Acceptance of these Terms
By creating an Arkive account you confirm that you have read, understood and agreed to these Terms of Service, the Vault Storage Terms and the Privacy Policy. If you do not agree, do not create an account or submit cards to Arkive.
3. Eligibility and account
- You must be at least 18 years old, or have the consent of a parent or legal guardian.
- You are responsible for keeping your login credentials confidential.
- One account per person. Accounts are not transferable.
- You must provide accurate contact and shipping information.
4. Ownership of stored cards
Ownership of cards stored with Arkive remains with the customer at all times, unless and until ownership is transferred through an Arkive transaction (internal sale or external sale settled through Arkive). Arkive does not claim any ownership interest in stored cards. Arkive holds the cards as a custodian on behalf of the owner.
5. Submissions
- You warrant that you are the lawful owner of every card you submit, that the cards are genuine and not counterfeit, and that they are not subject to any third-party claim.
- Arkive may inspect, photograph, catalog and assign storage locations to submitted cards.
- Arkive may reject any submission, in whole or in part, at its sole discretion (e.g. counterfeits, damaged cards, unaccepted formats, suspected fraud). Rejected items are handled as described in the Vault Storage Terms.
- By submitting cards you authorise Arkive to handle, store and (where instructed by you) sell or ship those cards.
6. Marketplace
- Internal marketplace. You may list stored cards for sale to other Arkive customers. Internal sales transfer ownership without the card leaving the vault. Settlement is made through the customer's Arkive wallet.
- External sales. You may instruct Arkive to list specific cards on third-party platforms (e.g. Tradera, Cardmarket). Arkive will handle listing, communication, packing and shipping. External marketplace fees, payment processing fees and shipping costs are passed through to you, in addition to the Arkive service fee.
- All sales are final once a buyer has paid and Arkive has confirmed the transfer of ownership.
- You are responsible for declaring and paying any taxes that arise from sales of your cards.
7. Fees
Arkive charges storage, marketplace, external sales and withdrawal fees as published on the Fees & Pricing page. Arkive may update fees with reasonable advance notice. Fees already incurred at the time of a change are not affected. Continued use of the service after a fee change constitutes acceptance of the new fees.
8. Wallet and payouts
- Funds from completed sales are credited to your Arkive wallet.
- You may request a payout to a bank account that you control.
- Arkive may request identity verification, proof of ownership, proof of address, or additional information where required by law, fraud prevention procedures, payment providers, or operational risk controls.
- Arkive may delay, reject, suspend or request additional verification for withdrawals or payouts where fraud, ownership disputes, legal obligations or security concerns exist.
- Arkive does not pay interest on wallet balances.
9. Prohibited use
- Submitting counterfeit, stolen or otherwise unlawfully obtained cards.
- Using the service for money laundering, fraud or any unlawful purpose.
- Manipulating the marketplace through fake bids, wash trading or coordinated price manipulation.
- Attempting to circumvent Arkive's fees by arranging transactions outside the platform for cards held in the vault.
Arkive may suspend or terminate accounts, refuse transactions and report unlawful activity to the authorities in case of breach.
10. Limitation of liability
Arkive provides the service "as is" and exercises reasonable care in handling stored cards. To the maximum extent permitted by law, Arkive is not liable for indirect or consequential losses, lost profits, lost market opportunities or speculative future value of cards. Arkive's total liability for any direct loss or damage to a stored card is limited to the lower of (i) the declared value of the affected card or (ii) the documented fair market value at the time of loss. Nothing in these Terms limits liability for personal injury caused by Arkive's negligence or any other liability which cannot be limited under mandatory applicable law.
Any insurance coverage, compensation limits, valuation methods or reimbursement policies may be described separately and may change over time. Arkive does not currently provide a separate insurance product covering customer cards.
11. Changes
Arkive may update these Terms from time to time. Material changes will be notified to registered customers by email or in-app notification at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by Swedish law. Disputes shall be resolved by the competent Swedish courts, unless mandatory consumer protection law in your country of residence provides otherwise.
